2. Information We Collect

We collect personal information when you book a service through the booking system on this website, when you make a payment through our card payment provider Stripe, or when you contact us directly by phone, email or WhatsApp. This may include:

• Your name and contact details (phone number, email, address, postcode)
• The service you are booking or enquiring about
• Vehicle details you provide when booking or during your appointment
• Your marketing preferences (if you opt in)
• Payment and booking details — card payments are processed securely by Stripe; we hold only the booking record itself (service, date, deposit paid)
• Standard technical data such as your IP address and browser type, collected automatically when you visit our site

3. How We Use Your Information

We use your personal information to:

• Respond to your booking request or enquiry
• Arrange and carry out the service(s) you have requested
• Send you service confirmations and follow-up communications
• Send you marketing updates and offers, only if you have opted in
• Comply with our legal obligations

Our lawful basis for processing is legitimate interests (responding to enquiries and providing services) and consent (for marketing communications).

4. How We Store and Protect Your Data

Your information is stored securely and is only accessible to authorised staff. We take appropriate technical and organisational measures to protect your personal data against accidental loss, unauthorised access, disclosure or destruction. We do not sell, rent or trade your personal information to third parties.

5. How Long We Keep Your Data

We retain your personal information only for as long as necessary. Enquiry and booking records are typically kept for up to 6 years to comply with financial and legal record-keeping requirements. Marketing consent records are kept until you withdraw your consent. You may request deletion of your data at any time (see Section 7).

6. Cookies & Analytics

We use a small number of essential cookies that are required for the site to work — for example, remembering your cookie choice and keeping a booking session together. These are always active because the site cannot function without them.

We would also like to use Google Analytics to understand how visitors use the site so we can improve it. Google Analytics sets cookies and collects information such as the pages you view, roughly how long you spend on them, and general location and device data. These analytics cookies are switched off until you choose “Accept All” on our cookie banner. If you choose “Essential Only”, no analytics cookies are set and no analytics data is sent.

We do not use advertising or re-targeting cookies, and we do not sell data to advertisers. You can change your mind at any time by clearing this site’s data in your browser, which will bring the banner back on your next visit. You can also block or delete cookies through your browser settings.

7. Your Rights

Under UK GDPR you have the right to:

• Access — request a copy of the personal data we hold about you
• Rectification — ask us to correct inaccurate or incomplete data
• Erasure — request that we delete your personal data where there is no legitimate reason to continue processing it
• Restriction — ask us to restrict the processing of your data in certain circumstances
• Portability — request transfer of your data in a machine-readable format
• Object — object to processing based on legitimate interests or for direct marketing purposes

8. Third Parties

We do not share your personal data with third parties for their own marketing purposes. We do share it with the following providers, only so far as is necessary to run our service:

• Stripe — our card payment provider. When you pay a deposit, balance or invoice, your card details are entered directly into Stripe’s secure checkout and are processed under Stripe’s own privacy policy. We never see or store your full card number.
• Google — Google Analytics, if and only if you have accepted analytics cookies (see Section 6), and Google Reviews, which we display publicly on our site.
• Our website host and email provider — who necessarily store the booking and enquiry data you send us.
• A DVLA-derived vehicle data provider — if you use our registration lookup tool, the registration you enter is sent to them to return your vehicle’s factory specification. We do not receive keeper or owner details from this lookup.

All of these providers are bound by their own data protection obligations, and we share only what each one needs to do its job.

We may update this Privacy Policy from time to time. The most current version will always be available on our website. Continued use of our website after changes constitutes acceptance of the updated policy.

These Terms and Conditions govern the use of our website and the provision of services by EC Performance. By submitting a booking request or using our services, you agree to these terms.

2. Booking & Acceptance

Submitting a booking request via our website does not constitute a confirmed booking. A booking is only confirmed once we have contacted you and both parties have agreed on a date, time and service. We reserve the right to decline any booking request at our discretion.

3. Pricing

All prices quoted are indicative and subject to confirmation following inspection of the vehicle. Final pricing will be agreed before any work commences. We reserve the right to amend quoted prices where unforeseen complications arise, and will notify you before proceeding.

4. Lifetime Software Warranty

Our lifetime software warranty covers faults directly attributable to our software modifications only. It does not cover mechanical failures, hardware faults, damage caused by third-party modifications, or issues arising from the use of incorrect or contaminated fuel. The warranty is non-transferable and applies to the original vehicle and owner only.

5. Customer Responsibilities

By booking a service, you confirm that:

• You are the registered owner of the vehicle, or have the owner's explicit permission to have the work carried out
• The vehicle is in a roadworthy condition and mechanically sound prior to any tuning work
• You understand that performance modifications may affect your vehicle's insurance — it is your responsibility to notify your insurer
• Any off-road solutions (DPF, EGR, AdBlue delete etc.) are fitted to vehicles used solely off public roads and in compliance with applicable law

6. Liability

EC Performance will not be held liable for any pre-existing mechanical or electrical faults that become apparent during or after our work. Our total liability in any circumstance shall not exceed the value of the service provided. We do not accept liability for loss of use, consequential loss or damage, or loss of earnings.

7. Cancellations

Online bookings are secured with a deposit, which is deducted from your final bill when the work is completed. The deposit is £50, and it is shown before you pay.

We ask for at least 48 hours’ notice if you need to cancel or rearrange. Give us that notice and we will move your booking to another slot, or refund your deposit in full if you would rather not rebook.

If you do not attend your appointment, or cancel with less than 48 hours’ notice, your deposit is non-refundable and will be retained. A booked slot means a bay, equipment and a technician set aside for your vehicle that we cannot offer to anyone else at short notice, which is the cost the deposit covers. The same applies if your vehicle arrives in a condition that makes the booked work impossible to carry out safely (see Section 5).

If you pay in full online, the same notice applies: cancel or rearrange with at least 48 hours’ notice for a full refund. For late cancellations and no-shows we keep the £50 deposit and refund the rest.

We apply this reasonably. If you have a genuine emergency, tell us as soon as you can — we would far rather move your booking than keep your deposit, and in practice we will usually transfer it to a new date. Repeated late cancellations may mean we ask for full payment up front on future bookings.

If we have to cancel or postpone your booking for any reason, you will always be offered a new date or a full refund of your deposit, whichever you prefer.

8. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
